DoT seek opinion from Additional Solicitor General of India on 3G roaming pact

The Department of Telecommunications (DoT) has sought legal opinion from Additional Solicitor General (ASG) A S Chandhiok on the unlicensed 3G roaming services provided by the telecom operators.

The operators Bharti Airtel, Vodafone India and Idea Cellular has only 2G licenses but they have made an mutual 3G intra-circle roaming pact and they are offering services in those circles where they do not have 3G spectrum.

DoT has also requested for his opinion on whether it can levy penalty on the telecom operators for violating licence conditions by offering 3G services in an unscrupulous manner.

Earkier, the two member bench of Telecom Disputes Settlement and Appellate Tribunal (TDSAT) gave a split verdict on the subject in which the telecom operators had challenged government’s directive to stop offering 3G services beyond their licensed zones through mutual roaming pacts.
